1. Purpose and Scope
This Data Processing Agreement (“Agreement”) supplements and forms part of the Terms & Conditions and Privacy Policy of UTHEDGEOFFICIAL LLC. It governs the processing of personal data received from clients, users, or business partners (“Data Subjects”) in connection with the mentorship, educational programs, and related digital services provided by the Company (“Services”).
This Agreement ensures compliance with applicable data protection laws, including the EU General Data Protection Regulation (GDPR), the UK GDPR, and relevant U.S. federal and state privacy laws.
2. Definitions
For the purposes of this Agreement:
“Data Controller” means the entity that determines the purposes and means of processing personal data.
“Data Processor” means the entity that processes personal data on behalf of the Data Controller.
“Sub-Processor” means any third party engaged by the Data Processor to process data.
“Personal Data” means any information relating to an identified or identifiable individual.
“Processing” means any operation performed on personal data, such as collection, storage, use, transfer, or deletion.
Under this Agreement, UTHEDGEOFFICIAL LLC acts as the Data Controller for all personal information it collects directly from clients and users, and may use trusted Sub-Processors (e.g., Systeme.io, Stripe, Dropbox, Discord, Google Analytics) to deliver its Services.
3. Categories of Data Processed
The Company may process the following categories of data:
Contact Information: name, email, phone number, Discord username.
Mentorship Data: credit score range, utilization rate, credit profile overview, and related educational information voluntarily shared by the client.
Uploaded Materials: documents uploaded via Dropbox or other platforms for mentorship evaluation (excluding SSNs, DOBs, or other sensitive PII).
Technical Data: IP address, device information, browser type, operating system, and session analytics.
Payment Data: processed through Stripe or other PCI-compliant processors (Company never stores raw payment data).
4. Purpose of Processing
UTHEDGEOFFICIAL LLC processes personal data strictly for legitimate business and educational purposes, including:
Delivering mentorship and educational Services.
Maintaining communication and account management.
Analyzing engagement metrics to improve program delivery.
Fulfilling legal, tax, or regulatory obligations.
Protecting against fraudulent, illegal, or unauthorized activities.
No personal data is sold, rented, or otherwise monetized.
5. Sub-Processors
To operate effectively, UTHEDGEOFFICIAL LLC engages certain trusted third-party service providers (“Sub-Processors”) that help deliver and support our Services. These providers process limited client information solely to perform their designated functions and are required to maintain strong data-protection and privacy standards consistent with applicable laws.
Our current Sub-Processors include:
Stripe, Inc. — provides secure payment processing and billing services (USA; PCI-DSS and GDPR certified).
Systeme.io — powers our CRM, email automation, and funnel operations (France/EU; GDPR compliant).
Dropbox, Inc. — provides encrypted document storage and file transfer functionality (USA; ISO 27001 and GDPR certified).
Discord, Inc. — hosts our private community and communication channels (USA; privacy-compliant under U.S. and EU standards).
Google LLC (Google Analytics) — provides website analytics and performance tracking (USA; GDPR and Standard Contractual Clause covered).
Each Sub-Processor maintains its own privacy and security frameworks and processes personal data only as necessary to support our legitimate business operations.
UTHEDGEOFFICIAL LLC ensures that all third-party partners provide at least the same level of data protection required under this Agreement.
6. Data Security
UTHEDGEOFFICIAL LLC implements industry-standard technical and organizational measures to ensure data security, including:
Secure (SSL/TLS) data transmission
Encrypted data storage (via third-party services)
Access control and authentication requirements
Regular system and vendor audits
Limited access on a need-to-know basis
Despite these measures, users acknowledge that no online system can guarantee absolute security.
7. Data Retention and Deletion
Personal data is retained only as long as necessary to fulfill the purposes for which it was collected, comply with legal obligations, or maintain legitimate business records.
Upon request, or upon termination of the mentorship relationship, UTHEDGEOFFICIAL LLC will securely delete or anonymize personal data unless legal obligations require retention (e.g., for accounting or dispute resolution).
8. International Data Transfers
Personal data may be stored or processed on servers located in the United States, European Union, or other jurisdictions where our Sub-Processors operate.
All transfers are conducted under recognized legal mechanisms such as Standard Contractual Clauses (SCCs) or equivalent safeguards.
By using our Services, you consent to the international transfer of your data under these protections.
9. Data Subject Rights
Where applicable under GDPR, UK GDPR, or other data protection laws, individuals have the right to:
Request access to their personal data.
Request correction, restriction, or deletion of data.
Object to certain types of processing.
Request data portability (a copy of their data).
Lodge a complaint with a supervisory authority.
Requests should be submitted to contact@uthedgeofficial.com and will be addressed in accordance with applicable law.
10. Breach Notification
In the event of a confirmed data breach involving personal data, UTHEDGEOFFICIAL LLC will:
Notify affected individuals and relevant authorities without undue delay,
Take all reasonable steps to contain and mitigate the breach, and
Cooperate with any required investigations or reporting.
11. Confidentiality
UTHEDGEOFFICIAL LLC ensures that all personnel and contractors with access to personal data are bound by confidentiality obligations and have received training on data protection principles.
12. Relationship to Other Policies
This Agreement supplements the Company’s Privacy Policy, Terms & Conditions, and any other relevant legal documents. In case of conflict, the provisions of this DPA shall prevail with respect to data protection obligations.
13. Governing Law
This Agreement is governed by the laws of the State of Missouri, USA, without regard to its conflict-of-law rules.
For EU/UK clients, GDPR compliance standards are observed where applicable.
